５　第一項の規定により保険金額が新保険業法第二条第十七項に規定する政令で定める金額を超える保険の引受けを行う場合において、その保険に係る再保険を外国保険業者に付すことが次に掲げる場合に該当するものとして内閣総理大臣の承認を受けた少額短期保険業者については、第二項の規定は適用しない。この場合において、当該少額短期保険業者は、内閣府令で定めるところにより、当該超える金額以上の金額を再保険金額とする再保険を当該外国保険業者に付さなければならない。例文帳に追加
