Through the 2009 Lisbon Treaty, the Member States of the European Union conferred upon the EU new... more Through the 2009 Lisbon Treaty, the Member States of the European Union conferred upon the EU new exclusive competences. The EU's common commercial policy was broadened to include foreign direct investment. However, the precise scope of the EU's new competence in the field of investment is not entirely clear. This presents EU decision makers in the various EU institutions with a multitude of complications. Building on the existing literature, the present paper analyses the scope of the EU's competences pertaining to investment in light of recent developments by drawing on precedents regarding the scope of EU competences and institutional practice. This paper argues that, taking into account the jurisprudence of the Court of Justice of the European Union, the new competence must be interpreted broadly, including the regulation of market access and material standards of protection and dispute settlement. The first part of this paper addresses the nature and definition of competence in EU law; the second part analyses the scope of the EU's investment competence. The analysis sheds light on divergent institutional opinions and is followed by a discussion of whether portfolio investments and protection standards as well as dispute settlement are covered by the EU's competences. The final part deals with future International Investment Agreements and negotiations in practice.

El presente documento analiza las normas internacionales existentes sobre la protección de los de... more El presente documento analiza las normas internacionales existentes sobre la protección de los derechos de propiedad intelectual en los acuerdos internacionales de inversión, con especial énfasis en los tratados bilaterales de inversión (TBI) y cómo se relaciona con el Acuerdo sobre los Aspectos de los Derechos de Propiedad Intelectual relacionados con el Comercio (ADPIC). El análisis demuestra que los estándares internacionales para la protección de los derechos de propiedad intelectual, después de la adopción del ADPIC, son inconsistentes. En el trabajo se analizan las normas ADPIC-Plus que han repercutido de manera sustancial sobre las flexibilidades previstas en el Acuerdo. En este trabajo se concluye sobre la necesidad de aclarar los parámetros jurídicos internacionales sobre el tema, y de esta manera asegurar la coexistencia armoniosa de las disposiciones acordadas en los TBI y ADPIC.

This article examines the potential challenges for the protection of intellectual property rights... more This article examines the potential challenges for the protection of intellectual property rights (IPRs) through International Investment Agreements (IIAs) in light of the new generation of IIAs negotiated by the European Union (EU). It argues that it will be difficult in practice to succeed in enforcing IPRs through IIAs. The article will do so by examining in detail the criteria international tribunals have required in order to consider IPRs covered investments, and then analyzing the key protection standards considering the interaction between investment treaties and the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS). Because negotiators have reacted to the legal issues raised in this context with new and innovative treaty language, this article will further examine these issues based on the EU’s IIAs. Their drafting practice should be taken as an indication that existing IIAs should be interpreted rather narrowly in respect of the protection of IPRs.

Background Data: Laminectomy for cervical spondylotic myelopathy with no signs of instability is ... more Background Data: Laminectomy for cervical spondylotic myelopathy with no signs of instability is a standard surgical option but it may be associated with postlaminectomy kyphosis. Study Design: Retrospective clinical case study. Purpose: To evaluate the clinical outcome in a series of patients who underwent laminectomy for cervical myelopathy with special stress on the incidence of postoperative spinal instability. Patients and Methods: This study included twenty two patients who underwent laminectomy at a single or more levels, without fusion, for cervical spondylotic myelopathy. The clinical assessment included history taking, neurological examination and postoperative clinical outcome. The radiological assessment included magnetic resonance imaging, computed tomography, and plain anteroposterior, lateral, and lateral flexion-extension X-rays of the cervical spine. The postoperative clinical outcome was assessed in comparison with the preoperative condition as: improved, stable or worsened. Results: Improvement of gait disturbance occurred in 69% of the concerned patients. Sensory deficits and radicular pain improved in the upper limbs (UL) and lower limbs (LL) in 73% and 50%, respectively. Motor deficits improved in the UL and LL in 69% and 55% of the patients, respectively. Postoperative clinical deterioration occurred in two patients (9.1%) and one patient (4.5%) developed postoperative kyphosis. Conclusion: Laminectomy usually results in improvement of the neurological deficits and radicular pain in patients with cervical spondylotic myelopathy with low incidence of postoperative clinical deterioration and instability.
