If you have indeed received an unwanted dickpic, the law is on your side. However, it is important to know that filing a criminal complaint is a serious matter that you should not take lightly. Briefly, any criminal case carries the following risks for the person filing the complaint:

  1. Risk of a false accusation

    If your statements are true: no problem. If you file a complaint that contains false accusations, this itself constitutes a criminal offense with serious legal consequences. Under Section 164 of the German Criminal Code, a false accusation can be punished by imprisonment of up to five years or a fine.

  2. Risk of being identified

    During the investigation, there is a certain probability that the perpetrator will be informed about your identity. If you do not want this under any circumstances, you should seek professional legal advice or get in touch with our consultation (German language content). There is also a procedure for this.

  3. Your role as a witness

    During the investigation and, if necessary, during a later trial, the authorities may request you as a witness for the court proceedings. Travel expenses and loss of income are usually reimbursed by the court. Such a subpoena as a witness may be mandatory.

    3. The internet service provider will provide the personal data and address of the offender to the authorities.
