As language conflicts grow within certain sectors of the population, translation and interpreting contribute to bridging the communication gap within multilingual nations. • Governmental social policies in the UK and Spain recognise the right to translation and interpreting in public settings, yet their implementation needs to be reinforced. • The provision of Public Service Interpreting and Translation (PSIT) has faced many challenges, and professionalisation is encouraged. The privatisation and outsourcing of court interpreting have proven to be detrimental to the profession. • In this paper, we call for close collaborations between governmental agencies and policymakers with translation organizations to ensure that the quality of PSIT is guaranteed.
An increasingly globalised and digitalised legal environment creates additional pressure for legi... more An increasingly globalised and digitalised legal environment creates additional pressure for legislative texts to be drafted in a clear and transparent way. In this chapter, I argue that text linguistics can make a valuable contribution to how this goal can be achieved. To substantiate this argument, I provide specific examples from legislative drafting in Switzerland. I show how the concepts and methods of text linguistics can help drafters identify and remedy impediments to the transparency of statutes and regulations at a functional, thematic and propositional level of textual structure. I conclude the chapter with a summary of the challenges that lie ahead and the solutions I believe we need to devise to maintain the transparency of the law in a globalised world.

Although the field of language and law has by now produced much wonderful work examining intersections of law and linguistics, much work remains in exploring the linguistic dimensions of the difficulties that continue to confound efforts at incorporating the insights of social science into the heart of legal scholarship.

This is the guest editors’ introductory paper to the special issue “Situating jurilinguistics acr... more This is the guest editors’ introductory paper to the special issue “Situating jurilinguistics across cultures using translation and discourse approaches.” The introduction showcases the interdisciplinary vocation of jurilinguistics from its conception almost forty years ago. It is argued that jurilinguistics has achieved its current maturity by diversifying the disciplinary lenses of the originally contributing disciplines of legal translation and legal studies while keeping faithful to its original principles—facing practical problems with a rigorous outlook, venturing into any new domains that may prove enlightening, and combining professional and academic perspectives. The authors highlight how the series of conferences “Jurilinguistics: Interdisciplinary Approaches to the Study of Language and Law” have been instrumental in enhancing the scope of jurilinguistics. Desde que se empleara por primera vez el término jurilingüística hace casi cuarenta años, este ha servido como paraguas para analizar las relaciones entre lengua y derecho. En destaca que les contribucions que s’hi publiquen reflecteixen un marc interdisciplinar estable de relacions entre llengua i dret, des de parametres com ara la traduccio, la interpretacio, la formacio, l’autopercepcio professional, la recerca teorica o l’elaboracio terminologica, alhora que recullen algunes de les noves tendencies en la materia i revisen de manera critica els paradigmes existents. Conclou que les aportacions publicades fan palesa la pertinencia de la jurilinguistica com a paradigma ampli i dinamic a partir del qual poder pensar les relacions entre llengua i dret.

Emanating from the recent sociological turn of translation studies scholarship (Wolf 2006, 2007, ... more Emanating from the recent sociological turn of translation studies scholarship (Wolf 2006, 2007, 2009 and 2010), translation and interpreting practices in non-governmental organizations has become a field of research that imperatively requires cross-disciplinary approaches. This paper investigates multilingual initiatives carried out by the Human Rights Investigation Lab (HRIL) and Translators Without Borders (TWB) and their contribution to ensuring language access in crisis scenarios. Based on interviews with delegates from both organizations, and taking into consideration legal and sociological perspectives, it sets out a broad reflection on how translation studies research is evolving in the area of NGOs. It intends to address the caveats that can arise from both conceptual and empirical approaches in the design of future projects, as it explores the notion of discipline-specific knowledge and relevant concepts in translation training and external collaborations.

As put in the foreword of this volume, Translating the Social World for Law: Linguistic Tools for... more As put in the foreword of this volume, Translating the Social World for Law: Linguistic Tools for a New Legal Realism combines perspectives, from scholars in such diverse elds as law, philosophy, anthropology, linguistics, political science, psychology and religious studies, into the notion of legal translation. Legal translation, as its name suggests, includes inter-and intra-lingual e orts to transfer legal knowledge (and documents) into another language, and also encompasses the translation of legal cultures. In a globalized world, in which there are speakers of a vast array of languages, professionals from many elds including law and other social sciences assume that communication with other professionals (in and outside their particular disciplines) is egalitarian if they have a shared language. This edited volume challenges this idea by o ering conceptual and empirical work that de nes translation as a cross-disciplinary communication tool, without necessarily involving strictly referring to two di erent languages, but highlighting cross-disciplinary meaning transfers. With the aim of fostering a better understanding between law and the social sciences, the authors call for a "New Legal Realism" (NLR that proposes language as a common element of exploration in legal theory.
La lengua y el derecho son dos campos de estudio estrechamente interrelacionados cuyas conexiones... more La lengua y el derecho son dos campos de estudio estrechamente interrelacionados cuyas conexiones siguen generando nuevos debates en distintas disciplinas. Con el objetivo de potenciar una reflexión interdisciplinaria entre investigadores y profesionales de estas áreas, Jurilingüística III: Enfoques Interdisciplinarios en el Estudio de la Lengua y el Derecho reflexionará sobre las aplicaciones de los enfoques jurilingüísticos en el análisis del derecho y de la lengua. Esta conferencia reúne a profesionales de ambos campos interesados en descubrir la naturaleza lingüística de los desafíos jurídicos (incluidos los políticos y sociojurídicos) y las implicaciones jurídicas del multilingüismo. Queremos favorecer una mayor comprensión en el sector jurídico sobre el trabajo que llevan a cabo profesionales de la lingüística y la traducción, en un contexto de creciente interés por sus herramientas y el estudio científico de las lenguas por parte de abogados y juristas. En un contexto de creciente colaboración entre profesionales e investigadores del derecho y de la lengua, se desarrollan programas bilingües (y multilingües) de formación en derecho internacional, aumenta la demanda de formación jurídica especializada de lingüistas y traductores, se comienza a utilizar herramientas de lingüística de corpus en la interpretación de jurisprudencia, se crean estructuras supranacionales y, gracias a la creciente cooperación internacional, se globaliza todo tipo de relaciones jurídicas... A medida que las sociedades desarrollan nuevos vínculos y necesidades plurilingües a nivel global, surgen lazos entre la lengua y el derecho que exigen el diseño de nuevos modelos de investigación interdisciplinarios, principios renovados y métodos de mayor complejidad. El coloquio Jurilingüística III: Enfoques Interdisciplinarios en el Estudio de la Lengua y el Derecho aspira a ser un lugar de encuentro entre profesionales e investigadores interesados por las intersecciones entre la lengua y el derecho desde disciplinas como los estudios de traducción e interpretación, la sociología, la antropología, la criminología y, evidentemente, el derecho y la lingüística. La finalidad del coloquio es identificar avances y conocimientos clave en este campo híbrido a la vez que explorar nuevas áreas de estudio e investigación. Abstract. In this article, we explore the emerging trends in the field of jurilinguistics in relation to legal translation research and practice. Since the term jurilinguistics was firstly used almost forty years ago, it has served as an umbrella to analyse the relationship between language and law. Although it was initially framed within legal discursive and terminological research, the globalisation of legal relations and social changes have resulted in an interest shift towards broader disciplinary limits, including forensic linguistics, pragmatics, anthropology and sociology, among others (Jiménez-Salcedo & Moreno-Rivero 2017). In translation studies, jurilinguistics has adopted a new meaning, far from a purely microlinguistic perspective, so it defines translation as a situated practice (Monzó-Nebot & Moreno-Rivero 2020). Under the framework of jurilinguistics, this paper explores three main axes in legal translation: firstly, we will review current research trends on legal genres and how to translate them; secondly, we will examine the synergies between corpus linguistics and legal translation; and thirdly, we will suggest methodological issues in legal translation training.
