This article discusses challenges related to the social security and employment status of highly ... more This article discusses challenges related to the social security and employment status of highly mobile workers in the live performance sector. These are persons whose place of employment is not a particular Member State but Europe. As such, these challenges arise from their often-weak connection to a specific Member State. The article provides an overview of a number of problems that mobile artists and their employers encounter under the EU legal framework for posting of workers and social security coordination, and explores some possible solutions.

Although the directive does not include such an explicit obligation, the Court concludes that the absence of such a system would undermine the effectiveness of the directive. The Court's reasoning is underpinned, first, by the importance of the limitation of working time for the protection of health and safety of workers. Second, the Court stresses the weaker position of the worker in the employment relation, which makes it even more important to establish a way to prove eventual violation of working time limits and rest periods. Exceptions to the obligation should be narrowly construed and can be based only on sectoral specificities, undertaking characteristics and on situations where the working time is not measured or predetermined or can be determined by the workers.

This decision is based on a selective representation of the facts and sits difficultly with the letter of the law and the intention of the legislator.

Après avoir manqué, de quelque mois à peine, le dixième anniversaire du célèbre arrêt Laval 1 , l... more Après avoir manqué, de quelque mois à peine, le dixième anniversaire du célèbre arrêt Laval 1 , la reforme de la directive détachement 2 vient d'être adoptée. Pendant ce temps, elle avait parue, à moments, tout simplement impossible à atteindre, jusqu'à ce qu'elle ne refasse surface dans le discours de M. Juncker devant le Parlement européen, le 15 juillet 2014 3 . A cette occasion, le nouveau président de la Commission européenne avait promis une réforme de la directive détachement avec l'objectif d'assurer que « [d]ans notre Union, un même travail effectué au même endroit devrait être rémunéré de manière identique ». La Commission européenne a donné suite à cet objectif en présentant sa proposition pour une réforme de la directive, le 8 mars 2016 4 . Cette dernière allait dans la direction générale d'une plus marquée égalité dans les conditions de travail des travailleurs détaché vis-à-vis celles des travailleurs « locaux » qui effectuent les mêmes activités. En se référant à cette proposition dans son discours sur l'Etat de l'Union du 13 septembre 2017, M. Juncker a encore une fois souligné cet aspect, en affirmant que « ceux qui font le même travail, sur un même lieu, doivent toucher le même salaire ». Cela est dû à de multiples facteurs, notamment la réticence de la Cour européenne de justice à contrôler les restrictions aux droits sociaux fondamentaux découlant des mesures d'austérité. Cependant, l'impact réel et le suivi des décisions rendues par les organes de suivi au niveau international restent largement inexplorés. L'article se concentre sur deux exemples spécifiques, tirés des expériences italienne et belge, pour évaluer dans quelle mesure la protection internationale des droits sociaux a un impact au niveau national. Dans le contexte italien, l'affaire FIAT montre que l'intervention du Comité de l'OIT sur la liberté syndicale n'a apporté aucune amélioration effective des droits syndicaux, en raison de problèmes de procédure et de la valeur incertaine de la convention de l'OIT dans l'ordre juridique national. Du côté belge, les auteurs examinent l'application faite par les juges nationaux d'une décision du Comité européen des droits sociaux, critiquant l'habitude de concéder des injonctions provisoires interdisant les activités de piquetage à l'occasion d'une grève. En l'absence d'une intervention de la Cour suprême, les auteurs soutiennent que l'impact de la décision du CEDS reste confiné au rôle de loi non contraignante. The use of customer ratings to evaluate worker performance is increasingly worrisome because of i... more The use of customer ratings to evaluate worker performance is increasingly worrisome because of its widespread use in the gig-economy. As scholars in computer and social sciences denounce, this practice entails the risk of producing discriminatory outcomes, by reproducing biases existing in society. By drawing an analogy with discriminatory practices adopted by an employer to satisfy its customers’ preferences, we propose a legal analysis of this phenomenon grounded in EU non-discrimination law. Thus, we first analyse the issues related to the application of non-discrimination law to (alleged) self-employed workers. Then, we address the lack of access for the individual worker to the data regarding customers’ ratings. We conclude by arguing that the use of customer ratings should be considered as a suspect criterion, while the current (EU) non-discrimination laws should be modernised through a clearer inclusion of (alleged) self-employed workers.
The European Union appears to be promoting at the same time both cross-national mobility of worke... more The European Union appears to be promoting at the same time both cross-national mobility of workers and an increased role for occupational pensions. There is, however, a potential tension between these two objectives because workers risk losing (some of) their pension rights under an occupational scheme as a consequence of their mobility. After long negotiations, the EU has addressed this issue through a minimum standards Directive. Shortly before the adoption of this Directive, the Court of Justice also delivered an important decision in the same field, in the case of Casteels v British Airways. By analysing the resulting legal framework for safeguarding pension rights under occupational schemes in the context of workers' mobility, we argue that the application of the case law developed by the Court of Justice in the field of free movement of workers has the potential to offer superior protection compared to the Directive. We also highlight the fact that the present legal framework seems to afford a much fuller protection to the intra-company cross-national mobility of workers employed by multinational companies, while also seemingly favouring mobility for highly specialised workers.

This book explores the complicated relationship between the EU legal framework for posting of wor... more This book explores the complicated relationship between the EU legal framework for posting of workers and collective labour law. It examines this topic from the perspective of EU law and of international labour law. In doing so, it builds upon a solid interdisciplinary foundation, which looks at sociological and economic aspects of the posting phenomenon, taking also into account issues related to industrial relations. However, the immediate focus of the present book is on the creation and evolution of the said EU legal framework. Hence, it provides an in-depth analysis of the drafting process of the Posting of Workers Directive (96/71) as well as an exhaustive examination of the case law of the Court of Justice of the EU dealing with posting of workers.
This evolving legal framework is subsequently considered in its broader context. Two tensions are thus identified. In particular, it analyses the so-called “New Economic Governance” of the EU, and its role in fostering such a trend. The author outlines the far-reaching implications of the lack of coherence between the action of the EU institutions involved in the “New Economic Governance” and the case law of the Court of Justice dealing with posting of workers.
