Criminalization of gender-related killing of women and girls

This paper is an updated version of a comparative legal analysis carried out by the United Nation... more This paper is an updated version of a comparative legal analysis carried out by the United Nations Office on Drugs and Crime on the criminalization of ‘femicide’ and similar forms of gender-related killing. It examines how different forms of gender-related killing of women and girls are characterized as criminal offences in 25 jurisdictions across the world. It highlights common elements and key differences in the definitional elements and the corresponding penalty. The paper identifies four main ways of criminalizing the gender-related killing of women and girls, most of which give rise to higher penalties than for ‘ordinary’ homicide. The paper also discusses possible advantages and disadvantages of criminalizing such killing, especially in relation to woman-specific provisions, and concludes with a number of questions and issues that require further research and discussion.

Environmental Refugees: How to ensure adequate legal protection

The increasingly felt results of climate change have sparked concerns about the lacking legal pro... more The increasingly felt results of climate change have sparked concerns about the lacking legal protection of persons fleeing environmental degradation or natural disasters. Based on the assumption that such “environmental refugees” exist and deserve protection, the present study identifies the gaps in the existing legal framework and examines the merits of proposed protection regimes. In the light the features of existing law and relevant state practice, it will become clear that the internal aspect of environmental displacement should be addressed separately from its cross-border dimension. Furthermore, this analysis shows that many legal and not only practical reasons militate against an extension of the Refugee Convention. Among other interesting proposals based on human rights or environmental law, a multilateral temporary protection regime would be the most effective response to the collective flight of high numbers of environmentally displaced persons. Such a regime would be flexible enough to provide durable solutions and to negotiate an equitable burden sharing, while representing an attractive option for States, who are likely to refuse unforeseeable legal commitments.
