BentBox by Haas & Reed B.V. (registration number 68817940) located at Mantelmeeuwhof 15, 3582DN, Utrecht, Netherlands and its affiliates or assigns operates and manages the Website platform accessible at https://bentbox.co/, including all its subdomains, where independent content uploaders can upload, publish, share and sell their original content, photos, videos, services or other tangible goods to users, and where uploaders and users can interact.

Copyright Respect: BentBox respects the copyright of all uploaders. Uploaders always retain all rights to their content.

1. Definitions

Where used in these T&C, unless there is something in the context or the subject matter inconsistent therewith, the following terms shall have the following meanings:

1.1. "2257 Regulations"

Shall have the meaning ascribed to such term in Section 3.8 herein;

1.2. "Content"

Shall mean, depending on the context in which it is used, original Uploader-generated content OR original MEMBER-generated content (or both), such as pictures, videos and other materials, including but not limited to, text, images, graphics, data, audio, messages, comments, memberships and tangible goods provided, sold, offered or posted by Uploaders or MEMBERS onto the Platform from time to time;

1.3. "Membership Content"

Shall mean Content or services provided by Uploaders on a recurring basis to supporting MEMBERS;

1.4. "Free Content"

Shall mean Content that an Uploader has made available to USERS or MEMBERS without payment;

1.5. "Premium Content"

Shall mean Content that an Uploader or a MEMBER has made available to USERS or MEMBERS for a charge;

1.6. "Interactions"

Shall mean all activities conducted on or through the Platform, including without limitation viewing, creating, sharing, selling, buying, liking, commenting, posting, messaging, and any other action;

1.7. "Member"

Shall mean any adult who has purchased Premium Content or Membership Content;

1.8. "Platform"

Shall mean the Website located at https://bentbox.co/ and all its subdomains, including, but not limited to all features, applications, content, downloads and other services or materials accessible via the Website, operated by BentBox, whether accessed through mobile or desktop;

1.9. "Rules"

Shall mean the rules of BentBox;

1.10. "Service Providers"

Shall mean any third-party contracted by BentBox to provide or facilitate services on the Platform;

1.11. "Services"

Shall mean all services made available by BentBox via its Platform;

1.12. "Uploader"

Shall mean any adult who has created an account on the Platform for the purpose of offering and posting Content for sale or free viewing;

1.13. "User"

Shall mean any adult who visits the Platform, whether or not they have registered for an account;

1.14. "You/Your"

Shall mean the User, Member, or Uploader, as applicable.

2. Accounts & Registration

2.1. Account Creation

To use certain features of the Platform, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Notify BentBox immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

2.2. Age Verification

By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms & Conditions.

2.3. Account Security

You are responsible for maintaining the confidentiality of your account credentials. BentBox will not be liable for any loss or damage arising from your failure to maintain account security.

3. Uploaders

3.1. Content Upload Rights

By uploading Content to the Platform, you represent and warrant that:

• You own all rights to the Content or have obtained all necessary permissions
• Your Content does not infringe on any third-party intellectual property rights
• All individuals depicted in your Content are at least 18 years old
• You have obtained all necessary model releases and documentation

3.2. Content Pricing

Uploaders have full control over pricing their Content. You may set your own prices for Premium Content and Membership subscriptions. BentBox operates on a commission-added model, meaning you keep 100% of your listed price while BentBox adds a commission on top for buyers.

3.3. Content Standards

All Content must comply with BentBox's content policies, including but not limited to:

• No minors or depictions of minors
• No illegal content or activities
• No non-consensual content
• No violation of intellectual property rights
• Compliance with all applicable laws and regulations

3.4. 2257 Compliance

Uploaders must maintain records as required by 18 U.S.C. § 2257 and 28 C.F.R. Part 75 for all Content featuring individuals. You are responsible for ensuring full compliance with these regulations, including proper age verification and record keeping.

3.5. Prohibited Content

The following types of content are strictly prohibited:

• Content featuring or appearing to feature minors
• Non-consensual or "revenge" content
• Content that violates any law or regulation
• Stolen or pirated content
• Content promoting illegal activities
• Content that violates third-party rights

3.6. Child Protection and Reporting

3.7. Law Enforcement Cooperation

Reporting of Pornography Involving Minors: BentBox is committed to cooperate with any law-enforcement agency investigating child pornography, and to comply with any applicable law relating to the mandatory reporting of pornography involving minors. We encourage you to report any such unlawful activities involving minors to the authorities.

NCMEC Reporting: We reserve the right to and do report suspected violations of the Platform's minimum age requirement to the National Center for Missing and Exploited Children ("NCMEC") and any and all law enforcement and other organizations we may feel appropriate, in our sole discretion. If you believe that a minor has accessed the Platform, you should immediately report it to us at [email protected].

3.8. Section 230 of the Communications Decency Act

The Platform is a Community Member-driven interactive platform with content provided by Independent Creators, and pursuant to Section 230 of the Communications Decency Act, we are immune from suit for materials published through the Platform by Community Members. As such, we are not liable for content published by Community Members. As we operate an online platform and we are not in the business of producing or presenting content, we have endeavored to keep our rules to a minimum imposing only those we feel are necessary for the safety of Community Members, to comply with applicable law, and the continued operation of the Platform.

3.9. Parental Responsibility

You understand and acknowledge your responsibility to prevent minors under your care from accessing explicit, harmful or otherwise inappropriate material: you understand that no minor can have access to Content, and you agree and warrant taking responsible measure to prevent them from doing so.

Parental control protections (such as computer hardware, software, or filtering services) are commercially available and may assist you in limiting access to material that is explicit, harmful or otherwise inappropriate to minors. Please note that we do not make any representation or endorsement regarding any products or information found on those websites, and recommend that you conduct your own due diligence before installing any online filter. Furthermore, you agree that is it your sole responsibility, at the total exclusion of BentBox's, to keep any explicit, harmful or otherwise inappropriate material from being displayed, viewed or accessed to by minors.

3.10. Human Trafficking - Zero Tolerance Policy

3.11. Reporting Suspected Trafficking

If you suspect human trafficking or exploitation on the Platform, please report it immediately:

Protection for Reporters: BentBox will protect the identity of individuals who report suspected trafficking in good faith. All reports are taken seriously and investigated promptly.

3.12. Content Creator Independence

All Uploaders must certify that they:

• Are acting independently and of their own free will
• Have complete control over their account, content, and earnings
• Are not being directed, controlled, or coerced by any third party
• Retain 100% ownership and control of their content
• Are not sharing account access or earnings under duress or coercion
• Have the freedom to stop creating or uploading content at any time
• Have direct access to all payout information and funds

Third-Party Management: While legitimate business arrangements (photographers, studios, managers) are permitted, any arrangement where an Uploader does not have full autonomy, free will, and direct access to their earnings is prohibited. BentBox reserves the right to verify the independence of content creators.

4. PayOuts & Earnings

4.1. Earning Structure

When you list Content for sale at a specific price, you will receive 100% of that listed price when the Content is purchased. BentBox adds its commission on top of your price for buyers, ensuring your earnings are never reduced.

4.2. PayOut Schedule

Payouts are issued monthly upon request. Requests are processed within the first seven (7) business days of each month for earnings accrued during the preceding month. Please submit payout requests to [email protected].

Uploaders are paid once they receive a minimum payment threshold of $100 USD. If you have questions about your payout status or need to request a payout, please email [email protected].

4.3. Payment Methods

BentBox offers multiple payment methods for creator payouts:

• Bank Transfer - Direct wire transfers to your bank account (international supported)
• Gift Cards - Receive earnings as gift cards from major retailers
• Yoursafe - Secure digital wallet for fast payments
• Paxum - Trusted e-wallet service for content creators
• PayPal - Available in select regions where supported

4.4. PayOut Requirements

To receive a payout, you must:

• Have a minimum account balance of $100 USD
• Have completed your account verification
• Provide valid payment details for your chosen payment method
• Comply with all tax reporting requirements in your jurisdiction
• Not have any outstanding violations of these Terms & Conditions

Note: Uploaders who close their account before the $100 minimum threshold is reached will forfeit the account's balance to offset infrastructure costs.

4.5. Revenue Sharing

BentBox offers flexible revenue sharing options. Uploaders may set up automatic revenue splits with collaborators (models, photographers, etc.). When revenue sharing is configured, BentBox will automatically distribute earnings according to the specified percentages.

4.6. Chargebacks & Refunds

In the event of a chargeback or refund, the corresponding amount will be deducted from your account balance. BentBox reserves the right to hold funds or delay payouts if there is suspected fraudulent activity or an unusually high chargeback rate.

4.7. Tax Responsibilities

You are solely responsible for reporting and paying all applicable taxes on your earnings. BentBox may be required to report earnings to tax authorities in certain jurisdictions. You agree to provide any necessary tax documentation upon request.

4.8. Withheld Funds

BentBox reserves the right to withhold payouts if:

• Your account is under investigation for Terms violations
• There are pending chargebacks or disputes
• Required verification documentation has not been provided
• There is suspected fraudulent or illegal activity

5. Members & Users

5.1. Purchasing Content

Members may purchase Premium Content or subscribe to Membership Content. All purchases are final and non-refundable except as required by law or as specified in our Refunds Policy.

5.2. Content Access

Purchased Content is for personal, non-commercial use only. You may not:

• Redistribute, share, or resell purchased Content
• Use Content for commercial purposes without explicit permission
• Modify, edit, or create derivative works from purchased Content
• Remove watermarks or other identifying information

5.3. Prohibited Activities

Members and Users must not:

• Harass, threaten, or abuse Uploaders or other Users
• Attempt to obtain Content without payment
• Share account credentials with others
• Attempt to circumvent payment systems
• Engage in fraudulent activities

6. Prohibited Content & Conduct

6.1. Reporting Violations

If you encounter prohibited content or suspect a user is violating these Terms, please report it immediately to [email protected]. We take all reports seriously and investigate promptly.

6.2. Consequences

Violations of prohibited content policies may result in:

• Immediate account suspension or termination
• Forfeiture of all earnings and balances
• Reporting to law enforcement agencies
• Legal action

6.3. Specific Prohibited Activities

The following activities are strictly prohibited and will result in immediate account closure and forfeiture of all PayOuts:

6.4. Content Deletion and Refund Policy

Content can be deleted and removed from all public pages at any time. Content that has been sold can be unpublished and removed from all public pages, and it will remain privately available to those users who have purchased access to the content.

Deleted Content - No Refunds: Deleted content that has violated our terms of use or that had to be completely removed following external events (e.g. legal investigation, deceased member, etc) will no longer be available for viewing or download and refunds will not be granted.

Refunds will not be available for deleted content that was sold as downloadable or for any transactions that have already been paid out to the seller.

7. Intellectual Property Rights

7.1. Your Content Rights

You retain all ownership rights to Content you upload to BentBox. By uploading Content, you grant BentBox a limited, non-exclusive license to display, distribute, and promote your Content on the Platform.

7.2. BentBox Intellectual Property

All Platform features, design elements, logos, and trademarks are the property of BentBox. You may not use BentBox's intellectual property without express written permission.

7.3. DMCA Compliance

BentBox respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe your copyrighted work has been infringed, please submit a DMCA notice to our designated agent.

8. Account Termination

8.1. Termination by You

You may terminate your account at any time by contacting [email protected]. Upon termination, you will forfeit access to your account but may request payout of any remaining balance subject to our payout policies.

8.2. Termination by BentBox

BentBox reserves the right to terminate these Terms & Conditions at any time, for any reason, with or without cause.

Common reasons for termination include:

• Violation of these Terms & Conditions
• Fraudulent or illegal activity
• Excessive chargebacks
• Failure to comply with age verification requirements
• Posting prohibited content
• Attempting to circumvent payment systems
• Promoting in-person meetings or using platform as dating service
• Failure to provide required model releases

8.3. Effect of Termination

Upon termination, your access to the Platform will cease. BentBox may retain copies of your Content as required by law. Any outstanding balance may be withheld if there are pending disputes or violations.

9. Disclaimers, Liability & Warranties

9.1. Platform "As Is"

The Platform is provided "as is" without warranties of any kind, either express or implied. BentBox does not warrant that the Platform will be uninterrupted, error-free, or secure.

9.2. Limitation of Liability

To the maximum extent permitted by law, BentBox shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

9.3. Indemnification

You agree to indemnify and hold harmless BentBox from any claims, damages, losses, or expenses arising from your violation of these Terms or your use of the Platform.

10. General Provisions

10.1. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles.

10.2. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in Utrecht, Netherlands.

10.3. Changes to Terms

BentBox reserves the right to modify these Terms at any time. We will notify users of material changes via email or Platform notice. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.

10.4. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

10.5. Entire Agreement

These Terms, together with our Privacy Policy and other referenced policies, constitute the entire agreement between you and BentBox.

11. Addendum

11.1. How BentBox Pays Uploaders

Uploaders are paid once a month upon request. PayOuts are processed within the first 7 business days of every month for the previous month.

Uploaders are paid once they receive a minimum payment threshold of $100 USD.

Uploaders receive an amount equal to the total of their calculated PayOut minus any fees incurred by BentBox to facilitate the payment (e.g. bank transfer fees, credit card fees, etc). You can find detailed information about PayOuts on this page: How we pay you

Uploaders can keep track and monitor their sales on these pages: PayOuts and Analytics

In order to be paid uploaders need to verify their identity as specified on the Account Settings page.

Uploaders must inform BentBox about new payment details by sending an email at [email protected].

Uploaders are encouraged to contact BentBox at [email protected] to make sure that their payment information is sufficient to process their payments.

11.2. Content Storage

BentBox is a sales platform, not a storage facility. Accounts that appear to be not generating sales may have their content permanently deleted in accordance with our terms of service.

11.3. Content Moderation

Users can report any content on BentBox by sending an email at [email protected] along with the link to the content in question. All disputes and issues will be reviewed and resolved within 7 days.

11.4. Content Delivery

To ensure a smooth and fast user experience on any web browser, all images and videos uploaded to BentBox are compressed for web viewing. This means that when you browse the site, you are seeing an optimized version of the content, not the original file.

Sellers have the option to make their original, high-quality files available for download. If a seller enables this feature, users who purchase the content will be able to download the original, uncompressed files.
