A familiar historical tradition asserts that before the declaration of the Second Punic War in 21... more A familiar historical tradition asserts that before the declaration of the Second Punic War in 218 BCE, the Roman embassy to Carthage offered the Carthaginians two alternatives: either surrender their commander Hannibal, whom the Romans claimed had broken the Ebro Treaty, or commence war. Within the past century of scholarship, it has become orthodox to explain the Roman demand for Hannibal's surrender in 218 BCE as an extension of the Roman civil legal principle of noxal surrender (noxae deditio) into the sphere of inter-state relations.
