Terms of use of the archiweb.pl portal

Use of the archiweb.pl portal is free of charge for Internet users and requires acceptance of the terms and conditions outlined in the regulations below.

I. GENERAL PROVISIONS

  1. The archiweb.pl Internet portal is made available to readers and users by Tomasz Kaim www.archiweb.pl, oś. Na Stoku 41/24, 31-707 Kraków, nip 676-216-42-81, hereinafter referred to as Service Provider.
  2. The Portal operates under the rules that are set forth in these Regulations.
  3. The portal is addressed to adults.
  4. These Terms and Conditions govern the rules under which the archiweb.pl portal may be used. At the time of taking action to use the archiweb.pl website, the User agrees to abide by the rules therein.
  5. Each User is required to read the Terms and Conditions before using the archiweb.pl portal
  6. In matters not regulated by the Terms of Service, the applicable provisions of Polish law shall apply. In the event of disputes, they will be resolved by the competent courts.

II. TERMS AND DEFINITIONS

  1. The archiweb.pl portal is a web platform that consists of online tools and pages made available through the mediation of the Internet. It is owned by Tomasz Kaim and is available at the following address archiweb.pl or at any other address for which archiweb.co.uk holds the rights.
  2. A user is any adult person who uses the archiweb.pl portal and
    Of the Services available on it.
  3. Partner is an entity that cooperates with archiweb.pl and with which a relevant agreement has been concluded
  4. Services - performances that are provided via an electronic platform by the Service Provider. They are provided via electronic means

III. RULES OF USE OF THE ARCHIWEB.PL PLATFORM

  1. The archiweb.pl platform allows you to use a number of Services, in particular:
  2. To read the Materials provided on the site in a manner corresponding to the User and chosen by him. In particular, this applies to the choice of the type of device or application used by the User through the web pages of archiweb.co.uk, as well as at the time and place corresponding to him.
  3. Posting of User Materials, which will be presented on archiweb.pl as part of the hosting service provided by the Service Provider, i.e. providing space on the Service Provider's servers.
  4. The Services are provided to the User through the archiweb.pl Service. This is done under the terms and conditions specified in these Regulations, except for the Services, which are described in separate regulations.
  5. Use of the Services at archiweb.pl is free of charge, unless otherwise specified in separate regulations.
  6. The archiweb.pl platform presents Materials - both informational content and
    and advertising.
  7. The Service Provider may post advertising content on archiweb.pl that refers to the goods or services of the Service Provider or its Partners. Advertising content forms an integral part of the archiweb.pl platform and the Materials that are presented in it.

IV. INTELLECTUAL PROPERTY

  1. All Materials contained on the archiweb.pl platform, i.e. trademarks, works, databases, etc. are subject to protection, which is provided for in the applicable Polish laws, in particular the Act of February 4, 1994 on Copyright and Related Rights (Dz.U.06.90.631 j.t. as amended), the Act of July 27, 2001 on Protection of Databases (Dz.U.01.128.1402 as amended), the Act of June 30, 2000 Industrial Property Law (Dz.U.03.119.1117 j.t. as amended) and the Act of April 16, 1993 on Combating Unfair Competition (Dz.U.03.153.1503 j.t. as amended).
  2. The rights to Materials, databases and trademarks that are made available through our platform belong to the Service Provider or to third parties. In the event that the rights in question are held by third parties, the Service Provider shall present them on its platform only after signing the relevant agreements concluded with the relevant entities, especially license agreements and contracts for the transfer of author's economic rights, or on the basis of the laws in force in this regard.
  3. The use of works made available on the archiweb.pl Service does not entitle Users to acquire rights or obtain licenses to the works posted on the platform.
  4. Users are entitled to use the archiweb.pl platform and the works posted on it, only within the scope of permitted use, which is provided by law in the Law on Copyright and Related Rights and the Law on Protection of Databases.
  5. In particular, it is forbidden to: modify, duplicate, block, publicly reproduce, publicly make available on the Internet the archiweb.pl platform or its parts, or the works posted on it or their parts, except in cases that are indicated by law.
  6. Materials posted on the archiweb.pl platform must be free of legal and physical defects, and must be free of claims by third parties. The User submits an appropriate statement in this regard and confirming that he/she possesses all the rights and consents required by applicable laws, in particular property copyright and rights to use his/her image, in order for the Materials to be made available on the archiweb.pl platform and not to infringe the rights or goods of third parties. Furthermore, he declares that the form as well as the content of these Materials do not violate applicable laws.

V. RIGHTS AND OBLIGATIONS OF THE USER OF ARCHIWEB.PL SERVICE

  1. Using the service, the user undertakes to comply with the law, moral and social norms, the provisions of the Regulations and the rules of netiquette. It is prohibited to:
  2. Post vulgar content and/or content containing vulgarities
  3. Post content that advocates socially radical views and attitudes, content that discriminates on the basis of race, ethnicity, religion, gender, etc.
  4. Post content that is considered offensive
  5. Post content that promotes the use of intoxicants, drugs, etc., alcohol abuse
  6. Post content that contains links to sites that violate good morals, the law, containing personal information, email, contact information, etc.
  7. It is forbidden to distribute pornographic content
  8. The user of the Platform is obliged not to violate the copyrights, property rights and goods of third parties.
  9. The user bears full and exclusive responsibility for the content posted on archiweb.pl, especially with regard to possible violation of the rights and/or goods of third parties.

VI. TECHNICAL CONDITIONS NECESSARY TO USE THE SERVICE

  1. Use of the archiweb.pl platform is possible with devices with access to the Internet and a web browser.
  2. Additional technical conditions may be included in separate Regulations.

VII. RODO

  1. Some services require the provision of personal data, which is fully voluntary. The processing of personal data is carried out in accordance with applicable laws, primarily the Act of August 29, 1997 on the protection of personal data (Journal of Laws 02.101.926, as amended) and the Act of July 18, 2002 on the provision of electronic services (Journal of Laws 02.144.1204, as amended).
  2. The administrator of the personal data is archiweb.pl
  3. Users' personal data is processed for the purpose of performing the Service to the extent that it is necessary to perform the Service.
  4. Users have the right to inspect their personal data, as well as the right to correct them and request their deletion. For this purpose, it is necessary to send a request by email. In the event that the data is necessary for the performance of a specific Service, deletion of such data means cancellation of the Service and termination of the contract for that Service.
