By accessing or using Apstal ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including visitors, registered users, and paying subscribers.
2. Description of Service
Apstal provides a web analytics platform that helps website owners understand visitor behavior and optimize performance. Features and availability may vary by subscription tier and may change over time.
3. Account Registration
You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized use.
4. Subscription and Billing
Paid plans are billed on a recurring basis (monthly or annually). Prices are subject to change with reasonable notice. All fees are non-refundable unless otherwise stated. A 14-day money-back guarantee applies to the first payment of new subscriptions.
You may cancel your subscription at any time. Access continues until the end of the current billing period. No partial refunds are issued for unused time.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose.
- Attempt to reverse-engineer, decompile, or extract source code from any part of the Service.
- Interfere with or disrupt the integrity or performance of the Service.

8. Fair Use
All plans are subject to fair use limits. We reserve the right to throttle or suspend access for accounts exhibiting excessive automated usage, abuse, or patterns inconsistent with normal human operation.
9. Free Plan Branding
Websites using the free plan must display the "Powered by Apstal" badge provided by the tracking script. This badge must remain visible, unobstructed, and unmodified at all times. You may not hide, remove, obscure, or alter the badge through CSS, JavaScript, or any other means.
Violation of this requirement may result in suspension or termination of your account. To remove Apstal branding, upgrade to a paid plan that includes the white-label feature.
10. Service Availability
We strive for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss resulting from service interruptions.
11. Limitation of Liability
To the maximum extent permitted by law, Apstal shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of revenue, data, or business opportunity — arising from your use of or inability to use the Service.
Our total aggregate liability for any claim arising under these terms shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
13. Termination
We may suspend or terminate your account at our discretion if you violate these Terms or engage in conduct harmful to the Service or other users. Upon termination, your right to access the Service ceases immediately. Sections related to intellectual property, limitation of liability, and governing law survive termination.
14. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a notice on the platform. Continued use after changes constitutes acceptance.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Apstal operates, without regard to conflict of law principles.
