No! There are other routes, called “alternative dispute resolution” to resolve the issues in your case. You can go to mediation, engage in settlement negotiations, and/or utilize the collaborative law method. Absolutely! Most contested divorce cases settle, it just varies on a case-by-case where in the litigation process that actually happens. You will have the opportunity to attend court-ordered mediation or mediation outside the court case process while the litigation is pending. Maryland employs a two-step modification process. First, you must prove a material change in circumstances. Then, provided a material change in circumstances is proven, the court will do a best interest of the child analysis.  The party seeking to modify has the burden of proof. You can enter into a prenuptial or postnuptial agreement to ensure future assets and earnings are protected in the way you wish for them to be protected.  However, these two agreements will be analyzed differently if a party challenges the validity of the agreement. No. Maryland is an equitable distribution state. Equitable does not mean equal.  There are statutory factors the court must consider when dividing marital property and the trial court is not required to divide property 50/50 in Maryland, although it frequently does.

Only if you can prove a “fault ground,” which is adultery and/or domestic violence. There is an exception allowing a party to file for a Limited Divorce while still residing with his/her partner/spouse, provided there are minor children.
