Privacy Policy

Privacy Policy of 321cuckold.com & 321cuckoldchat.com

Introduction & Scope.
This Privacy Policy explains how 321cuckold.com and 321cuckoldchat.com (collectively, “321C” or the “Website”) collect, use, disclose, store, and protect personal data when you visit our site(s), register for our chat, or use related services (including forum). It supplements and aligns with our Terms of Use. If you do not agree with this Policy, please refrain from using the Website.

Data Controller & Contact.
The controller responsible for your personal data is 321DigitalService (“we”, “us”, “our”). For privacy inquiries, please contact [email protected]. For abuse/DMCA or urgent safety matters, use [email protected].

Lawful Bases (GDPR).
We process personal data under one or more of the following legal bases: (a) contract (to create and manage your account and provide the chat/forum service); (b) legitimate interests (to ensure safety, prevent abuse, secure our services, maintain logs); (c) legal obligation (to comply with applicable laws, notice-and-takedown); and (d) consent (for specific optional features and cookies, where applicable). You may withdraw consent at any time without affecting prior lawful processing.

1) What personal information we collect.
When registering or using 321C, you may provide: username, email address, gender, (declared) age, and any profile details you choose to share. We also process content you upload (e.g., chat messages, images), limited technical identifiers (IP address, device/browser metadata), and safety signals (e.g., automated flags for prohibited content). For verification requests, you may submit images strictly for that purpose (see 11a).

2) When we collect information.
We collect data when you register, use the chat or forum, post content, interact with others, contact support, submit reports/appeals, or otherwise communicate with us. Limited technical logs may be collected automatically when you access our services.

3A) How we protect your information.
We use proportionate technical and organizational measures to protect data (e.g., TLS/SSL in transit, access controls, least-privilege administration, malware scanning, hardened infrastructure). Personal data is accessible only to authorized personnel with a need-to-know and confidentiality obligations. While no system is 100% secure, we continually improve our safeguards to reduce risks.

3B)Security incidents & liability disclaimer.
While we apply strong security measures, no platform can guarantee absolute protection against unauthorized access or hacking. In the unlikely event of a data breach, 321C will act promptly to mitigate harm and notify users or authorities as required by law. 321C shall not be liable for damages, losses, or claims resulting from any security breach, intrusion, or unauthorized access beyond our reasonable control. < br>
4) Cookies & similar technologies.
Yes, we use cookies. Cookies are small files placed on your device to recognize your browser and remember certain settings.
Strictly necessary cookies support core functions (login, session security).
Functional cookies improve experience (preferences).
Analytics may be limited to aggregate, privacy-respecting metrics; we do not allow third-party behavioral ads or profiling.
You can block or delete cookies via your browser. If disabled, some features may not function properly.

5) Third-party disclosure.
We do not sell or trade your personal data. We may share limited data with service providers (processors) who assist us in operating the Website (e.g., secure hosting, content delivery, email delivery, security/anti-abuse tooling), strictly under data processing agreements and only as necessary to provide the service. We may disclose data (i) when required by law or valid legal process, (ii) to protect users and our services, or (iii) to investigate/report illegal content (e.g., CSAM, non-consensual content).

6) Third-party links.
We generally do not include or offer third-party products within the Website. If users share external links in chat (contrary to rules), our Privacy Policy does not apply to those sites.

7) “Do Not Track” (DNT).
DNT is not a standardized EU/UK requirement. We do not conduct cross-site behavioral tracking or advertising. Where technically feasible, we avoid setting non-essential cookies if your browser signals DNT; otherwise, you can manage cookies in your browser or consent banner settings.

8) No third-party behavioral tracking.
We do not allow third-party behavioral tracking or targeted advertising on our Website.

9) Children (18+ only).
We do not market to or knowingly collect data from minors. Our services are strictly for adults (18+, or the age of majority in your jurisdiction, whichever is higher). Accounts suspected of underage use may be terminated and, where appropriate, reported.

10) Email & communications (CAN-SPAM/GDPR).
We may use your email to (i) send service notices and respond to inquiries; (ii) provide information related to account or safety; (iii) where opted-in, send optional updates. We will not use false or misleading headers, will include our contact address, and will honor unsubscribe requests promptly. To unsubscribe from non-essential emails, use the link provided or contact [email protected].

11a) Chat data, logs & verification content.
We will never use your private information, pictures, or chat logs for marketing. We will never resell or reshare pictures or chat logs you send.
Public chat logs & images: we do not store public chat logs or pictures longer than 48 hours; after ±48h content is deleted from our servers.
Private chat logs (text): retained for up to 7 days to support safety, moderation, and abuse investigations. Uploaded private images are deleted within 168hours.
Verification images (exception): images submitted for verification may be removed from the cloud and securely stored on the owner’s encrypted NAS for anti-abuse reference. If you request deletion, email [email protected] from your registered email and include your username. Deletion will remove your Verified rank because no reference remains.
Access to reported posts: Staff may access content that has been reported or flagged to review and action the report.
IP/ISP data: We do not share IP or ISP data except if legally required for an investigation into illegal acts.

11b) Post/Image deletion requests (private chat).
To prevent misuse (e.g., posting harmful content then deleting to evade moderation), users cannot self-delete uploaded content in private chats. If you accidentally post content, use the “Self Post Removal Request” under the gear icon in the private screen. Moderators will review genuine requests. Repeated misuse may result in penalties, including account removal. This policy supports user safety and platform integrity.

12a) Upload at your own risk (re-sharing outside the Website).
When you post in chat, other chatters can download your images. Even in verified rooms, other verified users may still save your pictures. We cannot control what others do outside our platform. Never share images online if you do not want them downloaded by others. 321C is not liable for downloading or re-sharing of your images by other users outside our Website.

12b) EXIF image information.
We strive to strip EXIF metadata from uploaded images. Due to browser differences, updates, or unforeseen issues, we cannot guarantee complete removal in all cases. Users remain responsible for removing EXIF before uploading. 321C is not responsible for any information disclosed through EXIF that persists for any reason.

13) Monitoring of information & safety scanning.
We reserve the right, but not the obligation, to monitor chat for safety and compliance. Private chats are not actively read. Automated scanning may flag combinations of risky terms/patterns (e.g., indicators of underage or non-consensual content). Positive matches are visible only to the owner for validation; false positives are disregarded.
Private chats and media may be reviewed if a user reports illegal activity, suspected stolen/reposted images, false or misleading information, or attempted false verification. If you converse with a user under investigation, your messages in that conversation may be reviewed solely for that investigation. We are not responsible for objectionable content transmitted by users (including hackers). We disclaim responsibility for any use/misuse of personal information that you voluntarily transmit.

14) Forum policies.
All Terms and this Privacy Policy also apply to our forum. Forum posts/media are not auto-deleted within 48h (unlike public chat). You can delete your own forum posts where functionality allows, or submit a takedown request to [email protected].

15) Double Account Policy (privacy notice).
Each user may maintain one account per role (e.g., one “Bull” and one “Cuck”). Creating additional accounts is prohibited unless expressly approved. Transfers of gold or virtual assets between self-owned accounts are not allowed. Violations may lead to suspension or permanent bans. See Terms of Use for enforcement details. This section is included here only to clarify associated processing of account identifiers for detection and enforcement.

16) Data retention.
We retain personal data only for as long as necessary for the purposes described: account provision, safety/abuse prevention, legal compliance, and dispute resolution. Specific periods include: public chat logs & images ≈ 48h; private chat text ≈ 7 days; private images ≈ 168h; verification images (exception) on encrypted NAS until you request deletion or they are no longer needed for anti-abuse; legal logs as required by applicable law. When data is no longer needed, it is deleted or irreversibly anonymized.

17) International transfers.
Where service providers or infrastructure are located outside your country (including outside the EEA/UK), we use appropriate safeguards (e.g., Standard Contractual Clauses, security and confidentiality commitments) to protect your data consistent with GDPR requirements.

18) Your rights (GDPR).
Subject to legal limits, you have the right to: access your data; rectify inaccuracies; request erasure (where applicable); request restriction of processing; object to processing based on legitimate interests; and data portability (for data you provided under contract or consent). Where we rely on consent, you may withdraw consent at any time. To exercise rights, contact [email protected] from your registered email and include your username.

19) Legal disclosures & safety reporting.
We may disclose or preserve data if (a) required by law or valid legal process, (b) necessary to enforce our Terms, (c) to protect the rights, safety, or property of users or the public, or (d) in connection with investigating/reporting illegal content (e.g., CSAM, non-consensual content) to competent authorities or hosting providers.

20) Changes to this Privacy Policy.
We may update this Policy from time to time. Material changes will be posted here (and communicated where feasible). Your continued use of the Website after changes take effect constitutes acceptance of the updated Policy.

21) Relationship to Terms of Use.
This Privacy Policy complements our Terms of Use. In case of conflict, this Policy governs personal data matters; otherwise, both documents apply together. Safety, non-consensual content, monitoring, reporting and appeals procedures follow the Terms of Use.

22) Liability & disclaimer (privacy context).
To the maximum extent permitted by law, 321C disclaims liability for indirect, consequential, special, punitive, or exemplary damages arising from processing consistent with this Policy. Where liability cannot be excluded under mandatory law, our liability is limited to the lowest amount permitted. Nothing limits liability where not lawful to do so (e.g., willful misconduct).
